1. Who we are
This webshop (fermosa.be) is operated by Fermosa BV, Louis Van Houttestraat 48, 9050 Gent, Belgium. Company and VAT number: BE 1022.391.876. Email: drink@fermosa.be.
2. Scope
These terms apply to every order placed on fermosa.be by consumers. By placing an order, you accept these terms. Orders from businesses (horeca, retail, distribution) follow separate agreements; contact us at drink@fermosa.be.
3. Products and age
Fermosa Pomegranate is non-alcoholic. Fermosa Amaro contains alcohol (5,5% alc.). We only sell alcoholic products to persons aged 18 or older. By ordering Fermosa Amaro you confirm that you are at least 18. We may ask for proof of age, and the carrier may refuse delivery to a minor. Product photos are illustrations; small differences in colour or packaging are possible.
4. Prices
All prices are in euro and include Belgian VAT. Shipping costs are shown before you pay: € 3,95 per order, free from € 50. Obvious pricing errors do not bind us.
5. Ordering and payment
The contract is concluded when you receive our order confirmation by email. You pay online via Mollie (Bancontact, credit card or Apple Pay). We ship once the payment is confirmed. We may refuse or cancel an order in case of suspected fraud, an underage buyer for alcoholic products, or when a product is no longer available; any amount paid is then refunded in full.
6. Delivery
We currently deliver in Belgium only. Ordering from another country? Contact us at drink@fermosa.be and we will look at the options together.
Orders ship within 7 days after payment. If your order has not arrived within 30 days, you may cancel it and we refund what you paid. Please check your parcel on delivery and let us know within 48 hours if anything is damaged or missing, ideally with a photo.
7. Right of withdrawal (14 days)
As a consumer, you may withdraw from your purchase within 14 days after receiving the products, without giving a reason. To do so, send us a clear statement by email to drink@fermosa.be (you may use the model form below). Return the products within 14 days after notifying us, unopened and in their original packaging. The cost of returning the products is yours.
We refund the price and the standard shipping cost within 14 days after receiving your withdrawal, using the same payment method. We may wait to refund until we have received the products back.
For health and hygiene reasons, bottles and cans that have been opened after delivery cannot be returned. If a product loses value because it was handled more than necessary, we may deduct that loss.
8. Legal guarantee and complaints
You are entitled to the legal guarantee of conformity. If a product is defective or not what you ordered, contact us at drink@fermosa.be and we will replace it or refund you. Please respect the best-before date and storage advice on the label. We aim to answer every complaint within 7 working days. If we cannot find a solution together, you can contact the Belgian Consumer Mediation Service (consumentenombudsdienst.be).
9. Liability
We are not liable for indirect damage, or for damage caused by improper storage or use of the products. Please drink responsibly. Nothing in these terms limits your rights as a consumer under mandatory law.
10. Privacy
We process your personal data as described in our Privacy Policy and Cookie Policy.
11. Applicable law
These terms are governed by Belgian law. Disputes fall under the competent courts of Ghent, without prejudice to the mandatory rights you have as a consumer in your country of residence.
